These terms form the agreement between ExecShot LLC and each person who uses the service. They cover who may open an account, what the service does and does not promise, how subscriptions work, and how the agreement ends.

Creating an account or using the service constitutes acceptance of these terms and of the Privacy Policy. Anyone who does not accept them should not use the service.
Frugain is a product of ExecShot LLC, a limited liability company registered in the State of Wyoming, United States. References to Frugain in these terms are references to that company.
An account may be opened by any individual aged 13or over. A user under the age of 18 must have permission from a parent or legal guardian, who accepts these terms on that user's behalf.
The service is not appropriate for anyone who is pregnant or breastfeeding, who has a history of disordered eating, or who has a medical condition affected by diet, without first consulting a qualified healthcare professional.
Account holders are responsible for the accuracy of the information they enter, for keeping access to their email account secure - sign-in codes are sent there, so it is the account - and for all activity that occurs under their account. Suspected unauthorized access should be reported to hello@frugain.com.
One account is for one individual. Credentials may not be shared, sold, or transferred.
Frugain calculates nutrition targets from information a user supplies, records food, weight and training entries, and suggests combinations of foods that meet those targets at the lowest estimated cost. Features may be added, changed or withdrawn as the product develops.
Frugain is a general information and budgeting tool. It is not a medical device, it does not provide medical, nutritional or dietetic advice, and it must not be used as a substitute for professional care. Nothing in the application is a diagnosis, a treatment plan or a prescription.
Calorie and macronutrient targets are estimates produced by published formulas applied to self-reported information. Individual energy requirements vary substantially, and no formula can determine what any particular person should eat. Anyone with a health condition, or making a significant change to their diet or training, should consult a physician or registered dietitian first.
Where a user records dietary patterns or allergens to exclude, the application uses them to filter its own suggestions. That filtering is a convenience and not a safety mechanism. It cannot account for how a food was manufactured, prepared, substituted or cross-contaminated. Every user with an allergy or intolerance remains responsible for reading labels and asking suppliers directly.
Nutrition information is drawn from the United States Department of Agriculture's FoodData Central database and from a curated set of staple foods. Prices are national average estimates, are not offers, and do not reflect any particular retailer, region or date.
Restaurant items shown in the eat-out suggestions are approximate figures for well-known chains. They are not supplied or endorsed by those businesses, and the trade marks named belong to their respective owners.
Users may correct any price to reflect what they actually pay, and corrections are used in place of the estimate for that user. ExecShot LLC does not warrant that any nutrition figure or price is accurate, current or complete, and accepts no responsibility for purchasing decisions made in reliance on them.
Payment processing is not enabled. During the beta period every account has access to all features at no cost, no payment details are collected, and no charge can be made. Prices are published in advance so that they are known before billing opens.
Food logging, the daily calorie and spending view, the cost-per-macro figure, weight tracking and the daily summary remain available without a subscription.

Rate limits are applied to protect shared upstream services. Circumventing them is a breach of these terms.
The application, its interface, its curated food and price data and the software behind its optimizer remain the property of ExecShot LLC. These terms grant a personal, non-exclusive, non-transferable right to use the service, and nothing more.
Information entered by a user remains that user's own. ExecShot LLC is granted only the limited license necessary to store, process and display it in order to operate the service for that user. That license ends when the information is deleted.
The service is provided on an as-available basis. It may be interrupted for maintenance, by faults, or by failures in the third-party services it depends on. No specific level of availability is guaranteed, and features may change or be withdrawn.
A user may delete their account at any time from the You screen. Deletion is immediate and permanent, and no copy of the deleted records is retained for recovery.
ExecShot LLC may suspend or terminate an account that breaches these terms, that is used unlawfully, or where required by law. Where circumstances allow, notice will be given first.
To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. No warranty is given that the service will be uninterrupted, error-free, or that any particular nutritional, financial or physical result will be achieved.
To the fullest extent permitted by law, ExecShot LLC shall not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, data or goodwill, arising from use of the service.
Total aggregate liability arising out of or relating to the service is limited to the greater of the amount paid for the service in the twelve months preceding the claim, or fifty United States dollars.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, in which case the limitations above apply only to the extent permitted there.
Users agree to indemnify ExecShot LLC against claims, losses and reasonable legal costs arising from their misuse of the service or their breach of these terms.
These terms may be updated as the service develops. The effective date at the top of this page records the current version. Material changes, including any change to the billing terms in section 7, will be notified in the application before they take effect. Continued use after that date constitutes acceptance of the revised terms.
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. Consumers resident elsewhere retain the protection of any mandatory provisions of their local law.
